1.Acceptance of Terms & Platform Role

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "Property Owner", "Client") and Hawaii Concrete Repair ("Hawaii Concrete Repair", "we", "us", "Platform"). By accessing hawaiiconcreterepair.com or submitting a structural concrete evaluation request, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to all terms and conditions set forth herein, you must immediately cease use of this website and our dispatch services.

2.Independent Contractor Dispatch & Liability Shield

All physical inspections, structural remediations, spalling excavations, epoxy crack injections, foundation underpinning, and retaining wall construction are performed exclusively by independent, verified Hawaii-licensed C-31 Structural Concrete Contractors operating under Hawaii Revised Statutes (HRS § 444) and regulated by the Hawaii Department of Commerce and Consumer Affairs (DCCA).

• Direct Contractor Agreements: Any formal structural assessment, repair agreement, pricing quotation, change order, construction warranty, or lien waiver is entered into strictly and directly between you (the property owner/client) and the independent licensed C-31 contractor.
• No Agency or Employment: Contractor partners are independent business entities and are not employees, agents, joint venturers, or partners of Hawaii Concrete Repair.
• Complete Shield of Platform: Hawaii Concrete Repair shall have zero responsibility, obligation, or civil liability for:
  • The quality, timeliness, completeness, or safety of any construction or remediation services performed.
  • Any property damage, structural settlement, water infiltration, accidental damage to adjacent condominiums, or personal injury occurring on or around your property.
  • Any licensing, insurance lapses, bond disputes, or mechanic's liens filed by contractor personnel or material suppliers.
  • Permit approvals or building code inspections through the City & County of Honolulu Department of Planning and Permitting (DPP), Maui County DPP, Hawaii County DPW, or Kauai County Planning Department.

3.Non-Binding Estimates & Structural Engineering Disclaimer

Online assessments and telephone triage do NOT constitute:

• A certified Structural Engineering Report or architectural analysis.
• A building code compliance certificate or life-safety sign-off for condominium AOAOs, commercial structures, or residential buildings.
• A binding contract, guaranteed quote, or firm scope of work.

Definitive repair specifications, permitting requirements, and exact pricing can only be determined through an on-site, physical diagnostic inspection performed by a Hawaii-licensed C-31 contractor or licensed Hawaii professional engineer (P.E.).

4.Property Authority & User Representations

By requesting an estimate or uploading damage documentation, you represent and warrant that:

• You are at least 18 years of age and possess the legal capacity to enter into these Terms.
• You are the fee-simple legal owner of the property identified, or you are an authorized property manager, general contractor, or officer of the Condominium Association of Apartment Owners (AOAO) with legal authority to grant access and commission structural inspections.
• All information, street addresses, and contact details submitted are truthful, current, and accurate.
• You will not use automated bots, scrapers, or bypass tools to submit fraudulent, malicious, or commercial spam inquiries through our dispatch platform.

5.Damage Photo & Content License

When you snap or upload photographs or videos of concrete spalling, retaining walls, or foundations to hawaiiconcreterepair.com:

• You retain your underlying ownership rights in the original photographs and videos.
• You grant Hawaii Concrete Repair a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, store, host, reproduce, reformat, and transmit those images to verified C-31 contractor partners, structural estimators, and engineering consultants for the purpose of diagnosing damage and scheduling assessments.
• You warrant that uploaded media does not violate the copyright, privacy, or intellectual property rights of any third party.

6.Communications Consent

By submitting your telephone number on our platform, you provide express written authorization for Hawaii Concrete Repair and its network of licensed Hawaii C-31 contractors to contact you via telephone call, automated conversational systems, and SMS text messages regarding your structural evaluation.

Consent to receive automated dispatch communications is not a condition of purchasing any property remediation services. You may opt out of SMS communications at any time by replying STOP.

7.Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY HAWAII LAW, THE PLATFORM, CONTENT, AND DISPATCH SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

HAWAII CONCRETE REPAIR EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, WORKMANLIKE QUALITY, STRUCTURAL SOUNDNESS, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL OPERATE UNINTERRUPTED, SECURE, OR ERROR-FREE.

8.Limitation of Liability

UNDER NO CIRCUMSTANCES SHALL HAWAII CONCRETE REPAIR, ITS FOUNDERS, OPERATORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE PLATFORM OR CONTRACTOR DISPATCH SERVICES.

THIS INCLUDES, WITHOUT LIMITATION, CLAIMS RELATING TO STRUCTURAL COLLAPSE, CONCRETE SPALLING CHUNKS, CORRODED STEEL REBAR EXPANSION, WATER LEAKS, PROPERTY VALUE DIMINUTION, TENANT DISLOCATION, INJURY, CONTRACTOR INSOLVENCY, PROJECT ABANDONMENT, OR COUNTY CODE VIOLATIONS.

IN ALL EVENTS, THE TOTAL AGGREGATE LIABILITY OF HAWAII CONCRETE REPAIR FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS ($100.00 USD).

9.Indemnification

You agree to defend, indemnify, and hold harmless Hawaii Concrete Repair, its affiliates, officers, directors, operators, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including reasonable attorney's fees) arising from:

• Your use of and access to hawaiiconcreterepair.com and its electronic dispatch channels.
• Your violation of any provision of these Terms or applicable Hawaii statutes.
• Any dispute, contract negotiation, breach of contract, or tort claim between you and any independent licensed C-31 contractor dispatched through our platform.
• Any physical damage, hazardous condition, or injury occurring at your property during an inspection or remediation project.
